Rapists 'Could Face Shorter Jail Terms'

Campaigners are angry at suggestions that sentences for rape could be cut

Rapists and other sex offenders could face shorter jail terms under new guidelines being prepared for judges, according to reports.

The body responsible for advising courts is set to call for sentences to be cut by 15 per cent to reflect the fact that custodial terms are now "more demanding", the Observer claimed.

And it could also set out scenarios in which mitigating circumstances could be taken into account.

More men convicted of domestic violence could also escape prison under separate proposals being drawn up by the Sentencing Guidelines Council (SGC), it said.

Those who persuaded courts they could change would instead be sent on courses aimed at changing their attitudes towards women.

The report comes just days before the Home Office launches a high-profile campaign to encourage young men to ensure that they have consent for sex - amid low conviction rates for rape cases in England and Wales.

Monday will see the start of a radio and poster-led drive to help cut offences.

A representative of the SGC is quoted as saying the fact that prisoners now spend at least half of their sentence behind bars and strict restrictions when released on licence could justify shorter sentences.

Julie Morgan, the Labour MP who chairs the all-party group on sex equality, told the paper any moves to cut sentences would be a concern, saying: "It is a terrible struggle for women to bring these cases to court and I don't think we ought to give the message that we think these crimes should be dealt with in a lighter way."

The SGC is an independent body whose role is to issue sentencing guidelines to assist all courts in England and Wales, to help encourage consistent sentencing.

It aims to offer "authoritative guidance" on sentencing and "enable sentencers to make decisions on sentencing that are supported by information on effectiveness of sentences and on the most effective use of resources".

Initial proposals are put out to consultation before final versions are drawn up.

No-one from the SGC was available to comment. A Home Office spokeswoman said decisions on guidelines were a matter for the SGC, but she pointed out that new laws had been introduced to ensure dangerous sex offenders were not released from jail.

Okay, I give up. In plain English what does it mean when someone says: "Custodial terms are more demanding"? Is that a way of saying that the jails are already full?

its no better in the u.s. my perp was charged with comitting sex acts on a child under 13' attempted murder ,unlawfull imprisonment,felony assualt,forcing a child under 13 to perform sex acts on him ,child pornogrophy,distributing child porn,his sentence 7 years for attempted murder all other charges were dropped ,after i sat there and described every detail ,they accepted a plea bargain . he didnt even put him down as a childmolester. some justice for a 13 year old kid who was destroyed in the process
