I have not seen the argument of their rights to publicity. As children, they couldn't consent to the sex, therefore they couldn't consent to the graphic depiction of the abuse and therefore it is a form of intellectual property theft. Anyone viewing it would have to know that the victim does not have the capacity to consent.
